www.laurenelisefineart.art (the website) is our website. These Terms and Conditions incorporate all the terms and conditions and policies on the website. By visiting the website and using it, you agree to these Terms and Conditions each time you view and use the Website. Should you need any help, please email lauren.elisefineart@hotmail.com

1          DEFINITIONS 

(1) “We”, “Us", or “Artist” means the artist who supplies and owns this website, Lauren Elise, with the email address lauren.elisefineart@hotmail.com. "Artwork" refers to the pieces of art or commissions that a Buyer agrees to purchase from us through the website, including made-to-order items, as described in each listing on the website.

(2) “Buyer” means the individual and/or organization who uses the website and may purchase Artwork.

(3) “Commissions” refers to artwork created according to the Buyer’s specifications, such as selecting a subject matter or color variations, like a painting based on a photograph. However, the Buyer should remember that artwork is a personal choice and should be clear if the Buyer has any specific requirements. 

(4) “Consumer” shall have the meaning as in s2(3) of the Consumer Rights Act 2015 and means “an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession.”

(5) “Intellectual Property Rights” refer to any patent, trademark, service mark, registered design, copyright, design right, contract or database rights, know-how, confidential information or process, any application for any of these, and any other intellectual property rights recognized worldwide, whether or not they currently exist or have been applied for, held by the owning party.

(6) “Made to Order” is artwork explicitly created for the buyer based on an original piece they like. It will be similar to the original, but due to its nature, it will have differences in design and color. No two paintings will be exactly alike in appearance.  Made-to-order artwork will not be an exact replica of the original.

(7) “Mainland UK” includes many final delivery addresses in England, Wales, N Ireland, and mainland Scotland.

(8) “Order confirmation” means the email confirming the Buyer’s order and will verify details such as what the Artist has agreed to provide, the price, and the expected delivery or supply date.

(9) “Standard Delivery” means a delivery method within Mainland UK, using a carrier approved by us, which is insured for at least the value of the sale price of the Artwork being shipped, and for which the carrier obtains a signature upon delivery as proof of receipt.

(10) “Terms and Conditions” means these Terms and Conditions, which also include all policies and other Terms and Conditions posted on our website. It also covers any special terms and conditions that we agree to in writing.

(11) “User” or “you” means anyone who uses or visits the Website for any reason, including but not limited to Buyers.

(12) “Website” means the website and all content at www.laurenelisefineart.art

2          ACCEPTANCE   

(1) Your access to and use of the Website are governed by these Terms and Conditions. By using the Website, you agree to these Terms and Conditions, along with all related policies and applicable terms. If you do not agree to these Terms and Conditions, you must immediately stop using the Website.

(2) When you use the Website on behalf of another person or organization, you confirm that

(a)  You have the legal right to do so and

(b) The other person or organization explicitly confirms that they will assume full responsibility for that use.

(3)(a) We reserve the right to update or change our Terms and Conditions at any time. These changes take effect immediately once posted on the website, and your continued use of the site after any updates will be considered your acceptance of those changes. It is each User’s responsibility to read the Terms and Conditions before using the Website each time.

(b) For clarity, the terms and conditions that apply to any purchase are those in effect at the time the purchase is made.  

3         WEBSITE USE 

(1) As a User, you agree that you are solely responsible for your use of the Website and that you will use the Website and everything available from it legally and only for its intended purposes. You will not misuse it in any way, and specifically, although not exclusively, you will:

(a) Do not reproduce the Website or any content or part of it unless you have our explicit written permission.

(b) Do not use any harmful component, including but not limited to, a virus, worm, Trojan horse, time bomb, or any similar code that could destroy or contaminate.

(c) Comply with any laws applicable to this Agreement or its operation.

(2) You acknowledge that you will not interfere or attempt to interfere with the proper functioning of the Website, any activities conducted on it, or any of its content. 

4          SUPPLY OF WEBSITE AND OTHER LAUREN ELISE FINE ART SERVICES

(1) While we will make reasonable efforts to provide the Website and ensure it is accessible on the internet, we are not responsible for any failure to deliver the Website or any of Lauren Elise's services, or for any periods of unavailability. The Website is offered on an “as is” and “when available” basis. We reserve the right, without any liability, to terminate or modify the Website and its contents at any time without prior notice.

(2) We cannot guarantee that Lauren Elise's services will be uninterrupted, secure, or error-free. Particularly, there are inherent problems with using the internet, and we will not be responsible for any interruptions, losses, or consequences of any kind, including tampering or hacking, nor for any browser crashes that may result in data loss while using Lauren Elise services.

(3) In addition, we make no warranties against electronic viruses, worms, or any other defects or problems that may occur while viewing or using the Website. We will not be responsible for any loss or damage caused by a failure to provide, or where a virus or defect occurs as a result of any email attachment or document we send to you. 

(4) We reserve the right to suspend the services where necessary and particularly, but not exclusively, for repair, maintenance or improvement.

5          THIRD PARTIES

The Website will include links to third-party providers who offer payment services. When you click on any links, you may be redirected to websites operated by third parties. We do not recommend, endorse, or have any control or responsibility over these third parties or their websites. You acknowledge that you will enter into a separate agreement unrelated to us, and you should review its terms. You explicitly confirm that we cannot be held liable for any issues arising from these third-party sites.

6        OUR INTELLECTUAL PROPERTY 

(1)(a) The Website and all the basic content—including text, images, marks or trademarks, and logos—except for anything uploaded or provided to us for upload—are protected by copyright owned by us. This means users can use the Website, but this does not give them any ownership rights or rights to use or display the copyrighted information in any way. 

(b) Artwork images on the website grant you explicit permission to use them on social media for promotional purposes, such as sharing an image you like on Facebook or Twitter. However, you cannot, for example, take a picture of the Artwork from the website and use it on your own website unless you have explicit written permission to do so.

(2) You will not, nor will you assist any other person or organization, in downloading, copying, assigning, transmitting, publishing, displaying (including public display), using, reproducing, distributing, modifying, creating derivative works of, or creating Internet "links" or frames to the Website or any part of it without our explicit written permission, including the use of our name and any copyrighted or trademarked content.

7        PRIVACY & DATA PROTECTION 

(1) We will collect, use, and store data in accordance with current Data Protection laws in England, as required by law for any individual’s personal information.  

You need to be aware of data protection changes and ensure that your data protection policy and processes are updated to reflect these changes.

8        LIMITATION OF LIABILITY 

(1) To the extent that the law allows, we will not be held responsible for any direct or indirect loss, incidental or consequential damage, or loss (economic or otherwise), any punitive or exemplary damages, any loss of reputation or goodwill or business opportunities or contact, or business interruption, however it arises, including out of negligence relating to or in any way connected to any use (unauthorised or otherwise), purchase of Artwork,  errors, mistakes, accident, theft or fraud, destruction, or any part of the provision of the Website or these Terms and Conditions.

(2) In the unlikely event that you have any right, claim or action against:

Us, then your claim will be limited to the sum of £150 or the amount you paid for the Artwork, whichever is greater.

9        INDEMNITY

You specifically agree to fully indemnify us against all claims, liabilities, damages, losses, costs, and expenses, including any legal fees, whether known or unknown, arising from or connected to your breach of these Terms and Conditions.

11    GENERAL TERMS 

These Terms and Conditions and Agreement shall be interpreted, construed, and enforced in accordance with English law and shall fall under the exclusive jurisdiction of the English courts.
